These Terms of Use ("Terms") govern your use of the Next Moment application and any other software, content or services made available by AOKA Creations ("AOKA Creations", "we", "us" or "our"). By downloading, installing or using our products, you agree to these Terms. If you do not agree, do not use our products.

1. iOS — Apple Licensed Application End User Licence Agreement

If you download Next Moment from the Apple App Store, your use of the application is also governed by Apple's standard Licensed Application End User Licence Agreement (EULA). This is a licence agreement between you and AOKA Creations (not Apple Inc.). Apple is not a party to this agreement and is not responsible for the application or its content.

Where these Terms and Apple's standard EULA address the same matter, both apply. In the event of any conflict, Apple's standard EULA takes precedence for iOS use.

2. Android — Google Play

If you download Next Moment from Google Play, your use of the application is governed by these Terms of Use. By installing the app through Google Play, you also agree to Google Play's Terms of Service, available at:

3. Licence grant

Subject to these Terms, AOKA Creations grants you a limited, non-exclusive, non-transferable, revocable licence to download and use Next Moment on a device you own or control, solely for your personal, non-commercial purposes. You may not sublicence, sell, copy, modify, distribute or reverse-engineer any part of the application.

4. Wellness disclaimer — not medical advice

Next Moment is a personal wellness tool designed to support reflection and emotional awareness. It is not a medical device, clinical service, or substitute for professional mental health treatment, therapy, diagnosis or crisis support. Nothing in the application or on our website constitutes medical or psychological advice.

If you are experiencing a mental health crisis or emergency, please contact a qualified healthcare professional or your local emergency service immediately.

5. Subscriptions and in-app purchases

Next Moment may offer subscriptions or in-app purchases. All transactions are processed through the relevant platform (Apple App Store or Google Play) and are subject to that platform's billing terms and refund policies. AOKA Creations does not process payments directly.

All content, design, code, graphics, trade marks and materials in the application and on our website are owned by or licensed to AOKA Creations and are protected by Australian and international intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

Your use of Next Moment is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Availability and updates

We may update, modify or discontinue the application (or any part of it) at any time without notice. We do not guarantee that the application will always be available, uninterrupted or error-free.

10. Disclaimer of warranties

To the maximum extent permitted by Australian law, Next Moment is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the application will meet your requirements or be free of errors.

11. Limitation of liability

To the maximum extent permitted by law, AOKA Creations and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the application — including but not limited to loss of data, loss of revenue, or emotional distress.

Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the application after any changes constitutes your acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of our products.
